2026 Sick Pay Rules: What Employers Need to Know

What’s Changing?
The upcoming reforms bring two key updates that employers and HR professionals should be aware of:
1. Removal of the Lower Earnings Limit
Previously, employees had to meet a minimum earnings threshold to qualify for SSP. Under the new rules, this requirement will be abolished, extending eligibility to a broader workforce, particularly benefiting lower-paid employees.
2. Elimination of the Waiting Period
The traditional three-day waiting period before SSP begins will also be removed. This means employees will now be entitled to sick pay from the very first full day of absence.
Why These Changes Matter
According to the Department for Business and Trade, these reforms are designed to enhance financial security for workers, especially those in lower-income roles. By ensuring quicker access to sick pay, the changes also aim to reduce the likelihood of employees attending work while unwell, helping to limit the spread of illness in the workplace.
What Employers Should Do Next
HR teams should begin preparing for these changes by reviewing internal sick leave policies, updating payroll systems, and communicating clearly with employees about their new entitlements. Ensuring compliance while supporting employee wellbeing will be key as these reforms come into force.
